Advise To Duluth Minnesota Renters Concerning Winter Utilities

As a tenant or homeowner living in Minnesota, losing utilities, particularly electricity and gas, can be deadly during the long harsh winters.  Minnesota has passed laws to protect homeowners and tenants from utility shut-offs during the winter months. 
By law, a landlord may not intentionally shut off a tenant’s utilities.  To do so is actually punishable by criminal law in Duluth Minnesota.  It is a misdemeanor and punishment can include a fine and jail time as well as a criminal record.  If a landlord does cut off utility services a tenant can sue to recover triple the amount of damages, or $500, whichever is more, plus attorney’s fees under certain circumstances.

If you come home to find that your landlord has turned off your utilities, you should immediately contact the landlord.  If a phone call does not immediately resolve the issue, then a written notice should be sent to the landlord.  If service is not restored within 48 hours, a tenant should notify a housing inspector.  If this is not effect, contact an Minnesota Real Estate Attorney immediately.  An Minnesota Attorney can help you negotiate with the landlord and demand he or she turn services back on, or if necessary, contact the utility company to try to place utilities in the name of the tenant.  If there are less than 5 units in the building, a tenant is allowed to take responsibility for the gas or electric bill and establish an account in the tenant’s names and deduct the costs from rent.

Additionally, Minnesota has a special Cold Weather Rule to protect tenants and homeowners from having heat, whether gas or electric, permanently disconnected between October 15th and April 15th.  Sometimes tenants and homeowners are not able to pay utility bills and this rule protects them if they are below 50% of the state median income.  Customers with household incomes above 50% of the state median have a right to make a payment agreement to prevent disconnection or get reconnected.  Also under the rule, a utility company must notify customers in writing prior to disconnecting the heat.

Utility users also have the right to appeal decisions to shut off utilities which is where an attorney can be of assistance.  If you are a homeowner or tenant and your utilities are shut off or you are concerned about your utilities being cut off due to a difficult financial situation, contact an attorney as soon as possible to discuss your rights and responsibilities.
